On 25 May 2022, Pre-Trial Judge Guillou issued a third decision on victims' participation in the Thaci et al. case. Twelve new applicants were admitted to the proceedings as participating victims. They will be included in the existing group of victims (Group 1 with 20 participating victims previously admitted) and shall be represented by the same Victims' Counsel.

On 20 May 2022, a Court of Appeals Panel denied the appeals, filed by Thaci and Veseli, against the decision of the Pre-Trial Judge dismissing the Defence challenges related to the legality of the KSC&SPO and alleged violations of certain constitutional rights of the accused. The decision is available in the Public Court Records.

During the status conference in the Thaci et al. case today, Pre-Trial Judge Nicolas Guillou issued an oral order directing the Defence teams to file their respective pre-trial briefs by Friday, 21 October 2022.

Today’s hearing in the Mustafa case is adjourned and the hearing, scheduled for tomorrow, 20 May, is cancelled. Following the Defence submissions yesterday reconsidering its previous position, the unsworn statement of the accused, pursuant to Rule 142 of the Rules, did not take place today. The trial is adjourned until further notice.

Another KSC weekly press briefing will take place on Thursday, 19 May, at 14:30. During this briefing, the KSC Spokespersons will provide a short update on the latest developments in the judicial proceedings before the KSC, as well as on other public activities of the Court. Today, Trial Panel II pronounced its Trial Judgment in the case of The Specialist Prosecutor v. Hysni Gucati and Nasim Haradinaj. The Panel found both accused guilty of obstructing official persons in performing official duties, intimidation during criminal proceedings and violating the secrecy of proceedings and sentenced each Accused to four and a half years’ imprisonment, with credit for time already served, and a fine of 100 EUR each.
