In its decision filed on 4 February 2022, the Trial Panel in the Mustafa case, having received three expert reports, concluded that the national courts in Kosovo do not provide a realistic avenue for the victims of the crimes charged in this case to claim reparations.  The Panel accordingly decided that, in case of a conviction in the Mustafa case, it will not refer victims to civil litigation in Kosovo courts pursuant to Article 22(9) of the Law and Rule 167 of the Rules, but issue a Reparation Order pursuant to Articles 22(8) and 44(6) of the Law. Furthermore, the Ministry of Justice of Kosovo is ordered to provide the Panel with answers, by 16 March 2022, to a number of questions related to this matter. Today, 4 February, the Specialist Prosecutor’s office closed its case against Salih Mustafa. The notification is here.

Trial Panel II today closed the evidentiary proceedings in the Gucati&Haradinaj case, ordered the parties to submit their final trial briefs by 3 March and scheduled the closing statements to take place from 14 until 18 March 2022. Here is the full order.

Yesterday, 2 February 2022, the Defence teams of Hysni Gucati and Nasim Haradinaj notified about the official closure of their cases. The notifications are here.

Following the completion of the testimony of the SPO last witness, the Mustafa trial is adjourned for the week. The next hearing is scheduled for 17 February, when the Defence preparation conference and the Victims’ status conference will be jointly convened.
