On 9 April, the Specialist Prosecutor filed, as confidential, its pre-trial brief in the case against Hysni Gucati and Nasim Haradinaj. The relevant filing informing of this submission is available here.

Following the appeals by Gucati and Haradinaj against the Pre-Trial Judge’s decision on their preliminary motions regarding, inter alia, alleged defects in the confirmed indictment, President Ekaterina Trendafilova assigned a Court of Appeals panel consisting of Judges Michèle Picard, Emilio Gatti and Kai Ambos to decide on the appeals. On 8 March, Pre-Trial Judge Guillou rejected both Gucati’s and Haradinaj’s preliminary motions challenging the jurisdiction and alleging defects in the indictment against them. The public redacted version of the decision is available here. 

On 8 March 2021, Pre-Trial Judge Guillou set 30 June 2021 as a tentative date for the transmission of the Gucati&Haradinaj case file to the Trial Panel. The rest of the consolidated calendar for the remainder of the pre-trial proceedings in this case is available here.

During the status conference in the Mustafa case on 5 March, Pre-Trial Judge Guillou issued the oral order inviting the Defence to file its pre-trial brief by 30 April. Furthermore, Judge Guillou ordered that, subject to the resolution of any outstanding matters, the transmission of the case file to the Trial Panel is anticipated to take place on or around 7 May 2021.
