Mustafa trial: agenda for the closing statements set
On 31 August, Trial Panel I set the agenda for the closing statements in the Mustafa case, scheduled to take place form 13 until 15 September 2022 (with 16 September as a reserve day). The agenda, which may be subject to changes decided by the Panel during the hearing, specifies, inter alia, that the SPO’s closing statement will take place on 13 September, followed by the statements of the Victims’ counsel and the Defence on 14 September. The responses, questions from the Panel and the statements on reparations are scheduled to take place on 15 September, the decision further reads.

KSC Weekly Press Briefing on 1 September

Pjetër Shala: Constitutional Court dismisses another referral re. fundamental rights violations
On 22 August 2022, the Specialist Chamber of the Constitutional Court, composed of Judges Vidar Stensland, Roumen Nenkov and Romina Incutti, issued its decision on the referral by Pjetër Shala alleging violations of his fundamental rights, filed on 19 July this year. The Panel found the referral premature and therefore declared it inadmissible pursuant to Article 113(7) of the Constitution, Article 49(3) of the Law and Rule 14(f) of the Rules of Procedure for the Specialist Chamber of the Constitutional Court. Thaci et al. case: Defence appeals re. alleged indictment defects denied
On 22 August 2022, the Court of Appeals Panel denied three appeals, filed by Thaci, Selimi and Krasniqi, against an earlier decision of the Pre-Trial Judge, in which some of the Defence’s preliminary motions were dismissed and the SPO was ordered to file a corrected version of the confirmed indictment. Shala case: new tentative date to transmit the case to trial
In his recent decision, the Pre-Trial Judge in the Shala case adjusted his initial projection of 31 August 2022 for transmission of the case to trial and set a new tentative date to 21 September 2022. Furthermore, the Judge extended the deadline for the Defence to submit its pre-trial brief from 15 August to 5 September 2022. The full decision is here.
